What Is the Balcony Inspection and Repair Act?

The Balcony Inspection and Repair Act, known formally as SB 721, was legislated as a direct response to prevent tragedies similar to the heartbreaking incident in 2015 where six students lost their lives due to a balcony collapse. This law mandates that owners of apartment buildings with three or more units carry out thorough inspections to ensure the safety and structural integrity of balconies, decks, stairways, and other exterior elements that are more than six feet above the ground.

The act, which came into effect at the beginning of 2019, sets a deadline for the completion of the first round of inspections by January 1, 2025. It applies to buildings that are two or more stories high, ensuring a broad scope to protect a significant number of residents. For larger buildings, it allows for a representative sample inspection of 15% of external elements, making it feasible for owners to comply without compromising on safety standards.

What Are the Requirements for Balcony Inspections Under the Act?

Under the Balcony Inspection and Repair Act, inspections must be carried out every six years to ensure the continued safety and structural integrity of balconies, decks, and similar exterior elements. These crucial inspections can only be performed by professionals holding specific qualifications, including licensed architects, civil or structural engineers, or building contractors.

The main aim of these inspections is to identify any hazardous conditions that could potentially pose a threat to safety. When such conditions are found, the inspector is required to report these findings to the local building official. Following this, building owners are given a timeframe between 15 to 120 days to make the necessary repairs, depending on the severity of the conditions identified.

During the inspection, the professional will closely evaluate the structural components such as joists, beams, posts, railings, and the integrity of waterproofing materials. They will specifically look for signs of water intrusion, dry rot, or any damage to metal flashings and deck coatings that could compromise safety.
